There are 5 vendors listed, 2 do not refund. I don’t see how the italian AGCOM could force the computer vendors to refund the operating system. There are much worse issues considering MS and Google monopoly and in general the total dependency from USA financial and IT services.

I’d almost bet that any refunds issued for pre-installed Windows probably doesn’t invalidate the firmware key that’ll likely activate fine after the refund. So people can double-dip 
There’s no guarantee someone with a refunded Windows key isn’t ever booting Windows on that hardware again nor any DRM preventing it.
But that’s also implying someone’s losing money; so who’s taking the hit, and why should they (or I guess how would you convince a store to do so since they likely bought the hardware with license-included and want to sell it as-is)?

Until all consumer devices come with Windows preinstalled the Windows key is not a problem for MS. The real deal would be a law that forces hardware vendors to provide the same devices without Windows preinstalled. But 99% people and the politicians more than anybody else, don’t see the reason for it because they want “ready to use” devices and surely they don’t want to make the effort. The success of smartphones is due both to the size and the fact that everybody can use them as they are. Gone are days of “directories” and “files”. Now think of your average politician who gets asked about “partitioning” and what “file system” to chose.
